Cat Lounge Visit Liability Waiver

HOW TO HANDLE CATS:

  1. Give the cats their space and do not restrict their freedom of movement.

  2. Do not harass the cats. If they want to be left alone, leave them alone.

  3. Refrain from making loud noises and stressing them out.

DISCLAIMER:

  1. We reserve the right to refuse entry and service to anyone.

  2. If you do anything that is detrimental to the well-being of the cats, we will kick you out.

  3. Those of you who bring kids, they are your responsibility. You MUST supervise your kids at all times. 

  4. Cats can be volatile. We cannot perform animal mind-control, so be wary around them. If they show signs of aggression or discomfort, please do not agitate them further. We are not liable if they lash out at you.

Liability Waiver & Release

SEATTLE MEOWTROPOLITAN makes available cats and/or kittens for petting, play and adoption by customers at the establishment and agrees to allow me to interact with same in consideration of both the payment of the fees for same and my execution of this Release and agreeing to be bound by its terms.

I am aware of and fully understand the inherent dangers involved in interacting with cats and/or kittens, including the risk of death and/or personal injury or damage to myself, other persons, minors accompanying me or in my care, my property, and/or the property of others while participating in such activities or having my property at the site of such activities. I am also aware of and fully understand the risks of visiting Seattle Meowtropolitan during the Covid-19 outbreak (see Covid-19 Addendum below).

I further acknowledge that participation in such activities may not be covered under insurance of Seattle Meowtropolitan Inc and that customers of Seattle Meowtropolitan may not have any right to file a claim against Seattle Meowtropolitan Inc's insurance policy. I freely and voluntarily execute this Release with such knowledge, and assume full and sole responsibility for the risk of death, personal injury and/or property loss arising from or in any way connected with visiting Seattle Meowtropolitan.

I agree to abide by all rules and regulations that Seattle Meowtropolitan Inc may impose regarding the cats and/or kittens, or regarding precautions to minimize risk of Covid-19 infection, by myself and by minors in my care who visit Seattle Meowtropolitan with me. I agree to follow all rules and to undertake all activities in a responsible manner. IF I AM UNWILLING OR UNABLE TO FOLLOW ANY RULES, SEATTLE MEOWTROPOLITAN INC WILL TERMINATE MY CONTINUATION OF SUCH ACTIVITIES, AND I WILL NOT BE ENTITLED TO ANY REFUND OF FEES.

I acknowledge that playing with cats and/or kittens may not be supervised, and Seattle Meowtropolitan Inc staff will not be with me or my party the entire time we are in contact with the cats and/or kittens, but Seattle Meowtropolitan staff will remain on the premises to monitor the activity of all current participants, offer guidance and encouragement, and be available to assist in the event of participant difficulty.

I and/or persons in my party agree not to engage in any activity that will injure or otherwise hurt the cats and/or kittens in any manner.

I and/or persons in my party hereby release and forever discharge Seattle Meowtropolitan Inc, its partnering rescues and shelters, their respective agents, owners, employees, and independent contractors, and their respective sureties, insurers, successors, assigns, and legal representatives, from any liability, claim, cause of action, demand and damages for injury, death or damages of any kind or nature whatsoever to myself or my property as a result of my visit to Seattle Meowtropolitan, whether such injury, death, or property damage is caused by the intentional or negligent act or omission on the part of (i) any other customer of Seattle Meowtropolitan Inc, (ii) any employee, agent, owners, or independent contractor of the Seattle Meowtropolitan Inc, or (iii) any other person at Seattle Meowtropolitan Inc. Furthermore, I agree to pay any and all attorney's fees and costs of Seattle Meowtropolitan Inc, and any of its respective agents, employees, owners, and independent contractors if I bring any action, claim, or demand against Seattle Meowtropolitan Inc or its partners, or any of its respective agents, employees, owners, and independent contractors for any reason for which this Release applies.

COVID-19 ADDENDUM

I acknowledge that I am freely choosing to visit Seattle Meowtropolitan during a Covid-19 outbreak and am aware of the risks attendant to such a visit. Seattle Meowtropolitan has restrictions and precautions in place to minimize BUT NOT ELIMINATE risk of Covid-19 infection, in keeping with the best practices recommended by epidemiologists and by city and state officials in charge of the Covid-19 public health response. I agree to follow all Covid-19 safety precautions recommended by the State of Washington and by Seattle Meowtropolitan staff.

My agreement to do so does not guarantee my safety. My failure to do so will be sufficient grounds for Seattle Meowtropolitan to refuse me service to ensure the safety of staff and other customers. I understand that if I have an unique susceptibility to Covid-19 that creates greater risk for me due to age or underlying conditions, it is my sole responsibility to assume the risk of contracting Covid-19 during a visit to Seattle Meowtropolitan. Should my visit to Seattle Meowtropolitan result in a Covid-19 infection traceable with certainty to Seattle Meowtropolitan , I hereby release and hold harmless Seattle Meowtropolitan Inc and its agents and representatives of ANY LIABILITY for medical conditions, illness or death, or for any medical costs.

I agree to and hereby bind my heirs, executors, assigns and all other legal representatives by executing this Release.

I hereby acknowledge and agree that this Release is intended to be construed and interpreted as broad and inclusive as permitted by the laws of Washington. If any portion of this Release is found or declared to be invalid or unenforceable, such invalidity shall not affect the remainder of this Release not found to be invalid and the remainder of this Release shall remain in full force and effect. This Agreement shall be governed by the laws of Washington (without regard to the laws that might be applicable under principles of conflicts of law, and without regard to the jurisdiction in which any action or special proceedings may be instituted), as to all matters, including but not limited to matters of jurisdiction, validity, property rights, construction, effect, and performance. All disputes shall be subject to litigation only within the courts of Washington.

BY EXECUTING THIS RELEASE, I ACKNOWLEDGE THAT I HAVE READ THIS RELEASE, UNDERSTAND THE CONTENTS HEREOF, HAVE BEEN ADVISED AND HAD THE OPPORTUNITY TO SEEK INDEPENDENT COUNSEL OF MY CHOICE AND CERTIFY THAT I HAVE FREELY AND VOLUNTARILY EXECUTED THIS RELEASE. I ACKNOWLEDGE THAT, BUT FOR THE EXECUTION OF THIS RELEASE AND AGREEING TO BE BOUND BY THE TERMS HEREOF, SEATTLE MEOWTROPOLITAN INC WOULD NOT AUTHORIZE ME TO VISIT SEATTLE MEOWTROPOLITAN INC.
